General Terms and Conditions
1/ SUBJECT:
The present Terms and Conditions are concluded on the one hand by the company Mikiko SARL whose head office is located at 2 Rue de la Cure 63730 Mirefleurs (France) and on the other hand by any individual or legal entity wishing to make a purchase via the Mikiko SARL website, https://porcs-epics. fr/, hereinafter referred to as “the Buyer”;.
The purpose of these terms and conditions is to define the contractual relationship between Mikiko SARL and the Buyer and the conditions applicable to any purchase made through the Mikiko SARL website.
Mikiko SARL will take care of order taking and delivery. Payments will be sent to Mikiko SARL.
Any order taken for a product appearing in the online shop of the site https://porcs-epics. fr/ implies prior consultation and acceptance of these conditions of sale.
Mikiko SARL reserves the right to punctually modify the present general conditions of sale with regard to legislative changes, the modifications made will be applicable as soon as they are put online.
2/ PRESENTATION OF THE ORDER:
Contractual information will be confirmed by e-mail to the address indicated by the Buyer on the order form. The products are those listed in the catalogue published on the “Porcs-épics Tricoteur” website. They shall endeavour to present all the characteristics by means of photographs and a descriptive sheet drawn up on the basis of the data supplied by the manufacturer. Mikiko SARL undertakes to use its best efforts to describe the products as accurately as possible, however, if errors or omissions may have occurred in this presentation, Mikiko SARL shall not be liable. Products are on sale within the limits of available stocks. In the event of an error concerning the availability of the article, Mikiko SARL undertakes to reimburse the Buyer. Some offers may be proposed for a short period of time which is the subject of a specific advertisement. The photographs in the catalogue are as faithful as possible but cannot ensure a perfect similarity with the product offered, especially with regard to colours.
Under no circumstances may an order be placed by professional sellers, alone or in groups, to meet the needs of their commercial activities, regardless of how their products are marketed. The Buyer acknowledges and accepts that Mikiko SARL reserves the right to refuse an order that has been clearly validated by a professional seller, with regard to the number of products ordered in a single order and with regard to the number of individual orders made for the same product compared to the usual quantity of an average consumer.
3/ PRICES:
The prices in the catalogue are in EUROS, exclusive of tax and including VAT. they can be displayed in other currencies. For VAT-exempt orders, the prices will be established exclusive of VAT.
Mikiko SARL reserves the right to modify the prices of the articles at any time, the articles being invoiced on the basis of the rates in force at the time of the validation of each order. The price of the Items invoiced is therefore the one indicated at the time of the Order.
As such, the payment of the totality of the price must be made at the time of the order.
The prices indicated do not include transport costs. Customs duties are at the Buyer’s expense.
The Customer acknowledges and accepts that the prices of the items are likely to vary between the Website, and that under no circumstances can this price difference be used as a basis for a request for total or partial refund of the Items purchased either on the Website.
4/ ORDER CONFIRMATION:
The Buyer who wishes to buy a product online must obligatorily:
– Indicate all the contact details requested for the correct delivery of the products;
– Indicate or confirm the billing address ;
– Confirm your order and payment;
– Confirm payment.
Payment implies full acceptance of these terms and conditions, the acknowledgement of having full knowledge of them.

5/ PAYMENT & SECURITY:
The accounts of Mikiko SARL are domiciled at CIC.
All the information exchanged to process the payment transits through the Stripe company, which as such assumes the security of your data.
The Buyer’s account will only be debited when the payment of the order is validated and when the amount of the products sent and the delivery costs are validated.

6/ TERMS OF DELIVERY :
The online sale of the products presented in the site is intended for Buyers who reside in all countries of the world.
Once the order has been validated, the address that the Buyer has transmitted for the reception of his order cannot be modified.

The delivery of the package is subject to the signature of the recipient. In case of absence, a notice of proceeding is deposited in your client’s mailbox, notifying him that he has 15 days to collect the package at the post office. For deliveries to the European Union and the rest of the world
For less than 100g shipping, by Petit paquet prioritaire Europe & international (La Poste): estimated delivery time: 5 to 14 working days. 7/ PRODUCT RETURNS :
Due to the nature of these items, unless they arrive damaged or defective, Mikiko SARL cannot accept returns for:
Custom or personalized orders
Digital downloads
Promotional items
Provided that the products are still in their original packaging and that they have not been worn, washed, ironed, retouched, soiled or destroyed, the Buyer benefits from a withdrawal period of fifteen (15) days from the delivery of his order.
To return an item, you must contact us within 15 working days of receipt of your package through the email address hello [at] porcs-epics. fr, describing the reasons for your return request, illustrated with photographs of the products and their packaging.
The return costs are at the customer’s expense. For metropolitan France, we recommend that you use Colissimo. The cost of “return” shipping remains the responsibility of the Buyer.
The right of withdrawal does not apply to legal persons.
In case of return of damaged goods, Mikiko SARL shall return them to the Buyer who shall be obliged to pay the shipping costs.
Upon receipt of his return, the Buyer will be informed by e-mail of the processing of his request. Mikiko SARL reserves the right to refuse a return in the following cases:
– Returned after the deadline, the right of withdrawal has not been exercised within fourteen (14) working days.
– Non-compliant return since the products must be returned in their original condition and packaging.
Mikiko SARL undertakes to reimburse the products returned under the above conditions within fourteen (14) days from the date Mikiko SARL is informed of the Buyer’s decision to withdraw. A confirmation email will be sent to you. The Buyer will be refunded the full amount of the returned products and delivery costs.
If you wish to make an exchange, it will be necessary to request a refund and place a new order.
8/ WARRANTY:
Mikiko SARL guarantees the conformity of the goods, allowing the Buyer to make a claim under the legal guarantee of conformity provided for in articles L. 211-4 and following of the Consumer Code.
In the event of non-conformity of a product sold, the Buyer may choose between repairing or replacing the product, subject to the cost conditions provided for in Article L. 211-9 of the French Consumer Code. If the repair and replacement of the product are impossible, the Buyer will be able to be refunded.
The Buyer will inform Mikiko SARL by e-mail at hello [at] porcs-epics. fr or by registered letter to Mikiko SARL – 2 Rue de la Cure 63730 Mirefleurs – France.
The Buyer must return the non-compliant product within fourteen (14) days from the date of delivery of the order. Mikiko SARL will bear the return costs.
9/ RESPONSABILITY:
Mikiko SARL, in the process of online sales, will only be bound by an obligation of means: its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service rupture or other involuntary problems.
However, Mikiko SARL may be exempted from all or part of its liability for non-performance or improper performance of the contract by proving that it is attributable either to the consumer or to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure. Force majeure takes into account irresistible facts or circumstances, external to the parties, despite all reasonably possible efforts to prevent them. 10/ INTELLECTUAL PROPERTY:
No one is authorized to reproduce, exploit, distribute or use for any purpose whatsoever, even partially, the elements of the site, whether visual or audio. Any single link or hypertext link is strictly forbidden, except with the express written consent of Mikiko SARL.
Consequently, any copy and use of the Porcs-épics Tricoteur brand, any parasitism resulting from the operation of the site will be automatically prosecuted and sanctioned.

11/ PROTECTION OF PERSONAL DATA:
In accordance with the law relating to data processing, data files and liberties of January 6, 1978, information of a nominative nature relating to the Purchasers may be the subject of automated processing. Within Mikiko SARL, the persons responsible for marketing, sales, customer relations and marketing, administration, logistics and IT departments and their line managers may have access to their data.

Likewise, users have the right to access and rectify data concerning them, in accordance with the law. At the first request of one of these Buyers wishing to be removed from its database, Mikiko SARL undertakes to delete all contact details and information.
